4.2 Cap on Liability

IN NO EVENT SHALL MILLS PRICE'S TOTAL LIABILITY FOR ALL CLAIMS RELATED TO PRICE DATA EXCEED THE GREATER OF THE FEES PAID BY YOU TO MILLS PRICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

4.3 Allocation of Risk

The limitations of liability in this section reflect a reasonable allocation of risk between Mills Price and users. Users acknowledge that Mills Price's fees are set in reliance on these limitations and would be substantially higher without them.
